Israeli security forces on Sunday arrested 10 Palestinians and wounded others on the second night of a crackdown on crowds gathering at Damascus Gate in occupied East Jerusalem. At least 19 people were injured as police used rubber-coated steel bullets, stun grenades, batons, and mounted forces to disperse crowds. Footage shared online showed Israeli forces, including undercover officers, beating and wounding Palestinians as they arrested them. On Saturday, four Palestinians were detained in the area as Israeli forces carried out a similar crackdown. Israeli police said they arrested people for “rioting and attacking officers”. One officer was injured by a bottle thrown in his face, police said in a statement. On Monday morning, Israeli authorities detained and interrogated people visiting those injured in the crackdown at al-Makassed Hospital, according to the news website Arab48. The attacks at Damascus Gate come amid heightened tensions and warnings of plans by Israeli settlers to storm al-Aqsa Mosque during the holy month of Ramadan, part of which will coincide with Jewish holidays. On Sunday, Israeli prime minister Naftali Bennett spoke over the phone with Jordanian King Abdullah who emphasised the need to “avoid any escalation”. The king called for “removing all obstacles to Muslim prayers at the Al-Aqsa Mosque compound, particularly with the start of the holy month of Ramadan, and to prevent provocations that could lead to an escalation,” a statement from the Jordanian royal court read.

ناپدیدشدگی اجباری Disappearances یکی از جرایم بین المللی است که تحت صلاحیت جهانی در تمام کشورهای دنیا قابل تعقیب و مجازات است. کنوانسیون ناپدیدشدگی اجباری مورخ ۲۰۰۶ است. طبق کنوانسیون این جرم شامل بازداشت، ربایش یا هرگونه محرومیت از آزادی به وسیله نمایندگان دولت یا اشخاص که با اجازه، حمایت یا رضایت دولت که موجب خارج شدن شخص از حمایت حقوق شود که همراه با انکار محرومیت از آزادی یا پنهان کردن سرنوشت مکان شخص ربوده شده باشد. ماده ۹ صلاحیت سرزمینی و شخصی فعال و منفعل و صلاحیت جهانی را مشروط به حضور متهم برای این جرم در نظر گرفته است.

باسمه تعالی لازم به ذکر است که قتل خاشقچی در کنسولگری عربستان واقع در ترکیه متضمن جرایم بین المللی مختلفی است: ۱- اعدام فراقضایی non-judicial executions : این اقدام مغایر با اصول حقوق بشر مانند اصل دادرسی عادلانه است. گزارشگر ویژه اعدام فراقضایی، اختصاری و خودسرانه در گزارش ۲۰۱۸ خود عربستان را در چند مورد محکوم به اعدام بدون رسیدگی عادلانه کرده است. ۲- تروریسم terrorism : کنوانسیون ممنوعیت کمک مالی مورخ ۱۹۹۹ است که عربستان هم در سال ۲۰۰۱ به آن پیوسته است. بند ۱ ماده ۲ کنوانسیون تروریسم را کشتن یا خسارت شدید به اشخاص غیرنظامی با هدف فعل یا ترک فعل جمعیت یا دولت یا سازمان بین المللی به یک امر است (هدف سیاسی). ۳- شکنجه torture : کنوانسیون مقابله با شکنجه یا دیگر رفتارها یا مجازات های ظالمانه، غیرانسانی و خشونت بار در سال ۱۹۸۴ تصویب شد و عربستان نیز در ۱۹۹۷ آن را پذیرفته است. طبق کنوانسیون شکنجه عبارت است از هر گونه خشونت جسمی و روحی با هدف اقرار یا گرفتن اطلاعات یا برای کار انجام شده یا کاری که قرار است انجام شود جایی که توسط اشخاص تحت نظر مقامات یک دولت انجام شود. ۴- گروگانگیری kidnapping or hostage: کنوانسیون در سال ۱۹۷۹ تصویب شد و عربستان در ۱۹۹۱ عضو شده است. طبق کنوانسیون بازداشت اشخاص یا تهدید به مرگ یا خسارت یا بازداشت شخص دیگر با هدف مجبور کردن دولت ثالث یا اشخاص برای عدم انجام کار که شرط آزادی گروگان هاست گروگانگیری محسوب می شود. ۵- سلب آزادی : میثاق حقوق بشر سلب حیات را بدون رسیدگی قضایی ممنوع دانسته است. ماده ۶ بیان می دارد Every human being has the inherent right to life. This right shall be protected by law. No one shall be arbitrarily deprived of his life. با این اوصاف عربستان در همین یک اقدام نادرست مرتکب کلکسیونی از جرایم بین المللی شده است. حمایت از ظلم ظالم همچون شراکت در آن ظلم است که فرمود: الرَّاضِی بِفِعْلِ قَوْمٍ کَالدَّاخِلِ فِیهِ مَعَهُمْ
